Welcome to www.normalnotwrong.com! It's great to have you here. This website is owned and operated by Jenelle Carto (“I” “my”, "me" or “myself') and my business, Normal Not Wrong. By visiting my website and accessing the information, resources, services, products, and tools I provide ("Resources"), you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as 'User Agreement'), along with the terms and conditions as stated in my Privacy Policy (please refer to my Privacy Policy for more information).

 

Please read these terms of use carefully before you start to use my site. By using this site, you accept these terms of use and agree to abide by them. If you do not agree to these terms of use, please do not use my site.

I reserve the right to change this User Agreement or my site at any time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions. Further, I will not be liable if for any reason my site is unavailable at any time or if the content is changed or out of date.

 

The content on or created by my site (including links to other sites and resources provided by third parties) are for informational purposes only. I shall not be liable for any use of, or reliance on, such materials or resources. It is your own responsibility to ensure that any products, services or information available through my website meet your specific requirements and needs. 

 

Responsible Use and Conduct 

 

By visiting my website and accessing the information, resources, services, products, and tools I provide for you, either directly or indirectly (hereafter referred to as ‘Resources'), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations, and generally accepted online practices or guidelines. 

 

Wherein, you understand that: 

 

a. In order to access my Resources and website, you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date. 

 

b. You are responsible for maintaining the confidentiality of any login information associated with any account you use to access my Resources. Accordingly, you are responsible for all activities that occur under your account(s). 

 

c. Accessing (or attempting to access) any of my Resources or website by any means other than through the means I provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of my Resources or website through any automated, unethical, or unconventional means. 

 

d. Engaging in any activity that disrupts or interferes with my Resources or website, including the servers and/or networks to which my Resources or website are located or connected, is strictly prohibited. 

 

e. Attempting to copy, duplicate, reproduce, sell, trade, or resell my Resources or any part of my website (including content, images, brand) is strictly prohibited without my prior written consent. If, in my opinion, you are in breach of these provisions, your right to use my site will cease immediately and you must either return or destroy any copies of the Resources or website content you have made.

 

f. You are solely responsible for any consequences, losses, or damages that I may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and you may incur criminal or civil liability. 

 

g. I may provide various open communication tools on my website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally I do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to my website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share or otherwise distribute any content that: 

 

i. is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;

 

ii. infringes on any trademark, patent, trade secret, copyright, or other proprietary rights of any party;

 

iii. contains any type of unauthorized or unsolicited advertising;

 

iv. impersonates any person or entity, including any Normal Not Wrong employees or representatives.

 

h. I have the right at my sole discretion to remove any content that, I feel in my judgment does not comply with this User Agreement, along with any content that I feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any third party copyrights or trademarks. I am not responsible for any delay or failure in removing such content. If you post content that I choose to remove, you hereby consent to such removal, and consent to waive any claim against me, my staff and my business, Normal Not Wrong. 

 

i. I do not assume any liability for any content posted by you or any other third party users of my website. However, any content posted by you using any open communication tools on my website, provided that it doesn't violate or infringe on any third party copyrights or trademarks, becomes the property of Normal Not Wrong, and as such, gives me a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as I see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration or application process, necessary in order to use my Resources and website. All information provided as part of my registration process is covered by my privacy policy. 

 

j. You agree to indemnify and hold harmless Jenelle Carto/Normal Not Wrong and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. I reserve the right to take over the exclusive defense of any claim for which I am entitled to indemnification under this User Agreement. In such an event, you shall provide me with such cooperation as is reasonably requested by me or my team.  

 

Privacy 

 

Your privacy is very important to me, which is why I created a separate Privacy Policy in order to explain in detail how I collect, manage, process, secure, and store your private information. Limitation of Warranties 

 

By using my website, you understand and agree that all Resources I provide are "as is" and "as available". This means that, even though I do my very best to provide high-quality, relevant, and helpful Resources, I do not represent or warrant to you that,

 

a. the use of my Resources or website will meet your needs or requirements,

 

b. the use of my Resources or website will be uninterrupted, timely, secure or free from errors,

 

c. the information obtained by using my Resources or website will always be accurate or reliable, and,

 

d. any defects in the operation or functionality of any Resources or website I provide will be repaired or corrected (although I will do my best where and when appropriate). 

 

Furthermore, you understand and agree that: 

 

e. any content downloaded or otherwise obtained through the use of my Resources, website, landing pages, Facebook ads, etc. is done at your own discretion and risk, and that you are solely responsible for any personal harm or damage to your computer or other devices for any loss of data that may result from the download of such content.

 

f. no information or advice, whether expressed, implied, oral or written, obtained by you from this site, Normal Not Wrong, myself, or any Resources I provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.

 

Limitation of Liability 

 

In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against myself or Normal Not Wrong shall be limited to the amount you paid, if any, for use of products and/or services. Normal Not Wrong will not be liable for any direct, indirect, incidental, consequential, or exemplary loss or damages which may be incurred by you as a result of using my Resources or website, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply. 

 

Intellectual Property 

 

All content and materials created by myself and Normal Not Wrong and that is available on www.normalnotwrong.com, including but not limited to text, graphics, website name, code, images, brand feel, and logos are the intellectual property of Normal Not Wrong are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display, or transmission of any content on this site is strictly prohibited unless specifically authorized by Normal Not Wrong in written format. 

 

Linking to Normal Not Wrong

 

You may link to my website (normalnotwrong.com) provided that you do so in a way that is fair and legal and does not damage my reputation or take advantage of it. Should, in my opinion, you violate these rights you will immediately remove links to my site and any corresponding content, as well as publicly repair such damages with an apology, correction of information, etc. I also reserve the right to withdraw linking permission without notice.

 

The website from which you are linking must comply with my User Agreement and must be owned by you. You must not link in such a way as to suggest any form of association, promotion, approval, or endorsement on my part where one does not exist. If you would like to link to my site in a way that suggests any form of association, promotion, approval, or endorsement on my part, you must obtain my written consent by emailing me at jenelle@normalnotwrong.com.

 

Termination of Use 

 

You agree that I may, at my sole discretion, suspend or terminate your access to all or part of my website and Resources with or without notice and for any reason including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent, or abusive activity may be grounds for terminating our relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources and website I provide will immediately cease, and I reserve the right to remove or delete any information that you may have on file with Normal Not Wrong, including any account or login information. 

 

Purchases

 

When making purchases on my website, you understand and agree to accept and adhere to the following purchase and refunds terms as stated below. Please read my purchase terms carefully before you make any purchases on my site, normalnotwrong.com or associated landing pages. By making a purchase, you accept these terms of use and agree to abide by them. If you do not agree to these terms of use, please do not make a purchase on this site or with my business, Normal Not Wrong.

 

The following terms and conditions apply to all Resources offered by myself and my business, Normal Not Wrong. The person or entity to purchase and/or participate in my Resources (“you”) agrees to the following Terms: 

 

1) Purchase terms will come into effect immediately after purchase of Resources and will continue until terminated in accordance with these terms. 

 

2) When purchasing a Resource in the form of a Coaching Package, you will schedule a free, 30-min introduction call so that we can get to know each other and ensure that coaching and my services are the right fit for you.

 

a) If we decide that a Coaching Package is not a great fit for you at this time, I may provide you with resources or referrals to other services or care providers. You are welcome to reconnect in the future by emailing me at jenelle@normalnotwrong.com. You may purchase other Resources at any time. 

 

b) If we decide that a Coaching Package would be a great fit for you, then:

 

i) I will email you a Coaching Agreement or use a third-party provider, “DocuSign” to send you a Coaching Agreement that is to be signed and sent back to me within two business days. If you do not send back a signed agreement within this time, I reserve the right to give your spot to another client and your payment will be refunded. 

 

ii) You will receive a confirmation email once payment has been processed. When I have received your payment, you will receive an email from me on how to get started. If you purchased Coaching I will approve your membership account within 12-hours or less and coaching will immediately begin in accordance with the instructions provided in my “Welcome Package” which will be emailed to you. 

 

c) If at any point, you made a mistake or error when making a purchase, please email jenelle@normalnotwrong.com for help with correction. 

 

d) Please print a copy of these Terms for your personal records as I will not file a copy and these Terms are subject to change. 

 

e) You are encouraged to read these Terms and Conditions in conjunction with your Coaching Agreement (if applicable) and the Privacy Policy that can be found in the footer of this website. 

 

Payments 

 

You understand and authorize that any Resources purchased through my site will automatically be charged to the eligible payment method I have on record for your account. Any membership or ongoing subscription purchased will continue to be automatically withdrawn from your account for the specified time period based on the Coaching Package selected (e.g., 4-monthly payments) to collect any and all outstanding receivables. Should the payment method you provided no longer be active or eligible, you agree to provide an alternative payment method to pay any and all outstanding receivables. Otherwise, legal action may be taken to collect the remaining amount owed and you will be responsible to pay for any legal and business costs I've incurred to do so.

 

Refunds & Cancellations 

 

When you make any purchase(s) from Normal Not Wrong, you are agreeing to a business transaction. Due to the nature of coaching programs and the immediate download of digital products, I do not offer refunds. All contracts and purchases are binding. Should you have a special circumstance that you believe entitles  you to a refund please email me at jenelle@normalnotwrong.com and I will review each request on a case by case basis. I reserve the right to decline any request for refund at my sole discretion.

 

Governing Law 

 

This website is controlled by Normal Not Wrong from my office located in the province of Alberta, Canada. It can be accessed by most countries around the world. As each country has laws that may differ from those of Alberta, by accessing my website, you agree that the statutes and laws of Alberta, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site. 

 

Furthermore, any action to enforce this User Agreement shall be brought in the federal or provincial courts located in Alberta, Canada. You hereby agree to personal jurisdiction by such courts and waive any jurisdictional, venue, or inconvenient forum objections to such courts. 

 

Guarantee 

 

Unless otherwise expressed, Normal Not Wrong expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.
